Medical Debt Relief Through Bankruptcy
It is not your fault if you find yourself falling behind on your medical bills. People don't plan for illnesses, injuries or accidents. Bankruptcy is designed to help those whose financial situation is more than they can handle. Medical debt is often the easiest debt to discharge in bankruptcy. The most important thing to note with medical debt is to save all medical bills. Whether it's a bill from the hospital, pharmacy, radiologist or a surgeon, keeping copies of all your bills is important to your situation.
Credit Card Debt and Bankruptcy
In Chapter 7, most (if not all) credit card can be discharged. Chapter 7 is commonly known as the "straight bankruptcy." In a Chapter 7 bankruptcy, you will usually keep your assets and your debts will be discharged. This is more common for people with limited assets or if they make below the median income, which is determined based on where you are located.
In Chapter 13, you will likely pay some of your debt back through a payment plan. Your payment will then be determined through a formula that takes into account your income and expenses. Your credit card debt will be discharged in Chapter 13 as well. It is important to note that as soon as you file Chapter 13, interest stops building on your debt.
